员工违纪问题,是很多用人单位非常“头疼”的问题。员工报销套取费用、吃里扒外飞单、操纵自己的公司和用人单位交易,这给用人单位造成巨大的损失,更有甚者,如果公司的高管也参与从事这样的行为,将直接影响公司利益,甚至导致公司几年的亏损甚至破产。更加悲剧的是,很多用人单位据此解除员工的劳动合同,由于证据的缺失,规章制度的不完善,在诉讼中败诉,不仅不能挽回损失,反而需要向员工支付赔偿。

Employee fraud is a very “troublesome” problem for many employers. Employees draw cash through reimbursement of fees, transfer orders of their employers to others, or manipulate their own companies to deal withemployers, which will cause huge losses to employers.What’s more, if a company's executives are also involved in such behaviors, it will directly affect the company's interests or put the company in the red for several years or even make the company go bankrupt. Worse still, many employers who terminate a labor contract accordingly lose a lawsuit due to lack of evidence and imperfect company rules. As a result, the employers can’t recover the losses, but have to pay compensation to the employees.

Sam Tang (Tang Qisheng), a seniorlawyer of TransAsia Lawyers and a former district-level judge of Shanghai will bring a wonderful sharing. In this course, he will analyze the prevention and treatment of employee fraud and the possible methods of claim for compensation lodged by employers from the perspective ofevidence collection of fraud behavior, formulation of rules, andtreatment of fraudbehavior.

唐启盛 Sam TangCCP特邀讲师

资深律师  上海市权亚智博律师事务所

唐律师在律所工作期间,主要为跨国企业提供合规服务,主要包括协助内部调查、法律文件的起草与审核、规章制度的设计、群体事件的应对以及参与仲裁、诉讼。唐律师先后应人社部、北京大学、上海财经大学以及上海市劳动监察学会等组织的邀请举办讲座,撰写的法律文章先后刊登于《检察日报》、《中国劳动》、《人力资源》等专业期刊,并担任《劳动报》、威科数据库的特邀劳动法专家。
